Tekashi 6ix9ine is going to have to spend the remainder of his prison sentence behind bars.
Judge Paul Engelmayer has denied Tekashi’s request to spend the remainder of his prison sentence at home on house arrest. The judge ruled that his crimes were too serious to allow any leniency.
“The Court recognizes that, as a result of security and related considerations that have resulted in his placement in a private jail, Mr. Hernandez, while incarcerated, may not have the same access to rehabilitative opportunities and programs as other Bureau of Prisons inmates,” Engelmayer wrote in his decision.
”The Court was mindful of this in fashioning Mr. Hernandez’s 24-month sentence,” Engelmayer said.
Tuesday (Jan. 15), the rapper’s attorney, Lance Lazzaro, sent a letter to the judge asking for him to be transferred to either a community correctional facility or back home. Lazzaro cites his client’s safety as the main reason for the request to be transferred.
“As a result of [6ix9ine’s] cooperation with the government against multiple gang members with the Bloods, [6ix9ine’s] safety is still, and will continue to be for the foreseeable future, seriously at risk,” Lazzaro’s letter reads.
Lazarro also said that he would be fine with Tekashi going to a community correctional facility, but his home would be the “most reasonable” way to continue out his 11-month sentence.
Last month, Tekashi was sentenced to 24-months in prison with five years supervised release for his involvement in a high-profile guns and racketeering case. He was initially facing 47 years in prison, but due to the rapper’s cooperation with police against the Nine Trey Gangsta Bloods, he was given a much lighter sentence. He was credited 13 months for time already served, moving his release date to the end of 2020.
