Kerry Lathan, one of the three victims who was shot outside of Nipsey Hussle’s clothing store late last month, is expected to be released from jail, TMZ reports.

The 56-year-old previously served a 25-year sentence, yet found himself behind bars again because of his interactions with the slain rapper. According to police, Hussle’s well-documented affiliation with L.A.’s Rollin’ 60s Crips gang made Lathan’s association with him a direct violation of his parole conditions.

Five days after the tragic shooting which left Lathan paralyzed and bound to a wheelchair, officers arrived at the halfway house where he was staying and apprehended him for “fraternizing with known felons or gang members.” He has remained incarcerated at the Men’s Central Jail in downtown Los Angeles. Now, it seems the courts have had a change of heart.

On Thursday (April 18), a representative from the L.A. Superior Court exclusively revealed to TMZ that the Department of Corrections and Rehabilitation has withdrawn its petition to revoke Lathan’s parole. While no reason for the decision was given, it is assumed that Hussle’s involvement in his community and his philanthropy efforts have been taken into account when deciding Lathan’s fate.

Lathan has maintained his position that he didn’t know Hussle as well, as initial reports suggested. “He might’ve gave me a couple pictures … When I got out, I took a selfie with him,” Lathan shared during an interview with VladTV earlier this month. “He’s a celebrity. Everybody’s taking selfies, let me take one. That’s on my phone in front of The Marathon Store.”

Lathan went on to say, “Nipsey heard that I was home and filled up my little sister’s backseat of her car with clothing for me… I was out seven months before [the shooting] happened.” As of press time, Lathan has not been released.
