The former Dallas police officer who fatally shot Botham Jean will have her appeal heard by a panel of judges next week, reports CBS Dallas. Amber Guyger, who is currently serving a 10-year sentence for killing Botham back in 2018, filed an appeal to her murder conviction last summer. The appeal will be heard by a three-person panel. They will listen to her legal team’s arguments and reveal their decision at a later date.
Guyger’s attorneys believe there is not enough evidence for their client to have been charged with murder. Instead, they want her found guilty of criminally negligent homicide, which would come with a lesser sentence.
In the August filing, the defense stated, “The evidence was legally insufficient to prove beyond reasonable doubt that Guyger committed murder because (1) through mistake, Guyger formed a reasonable belief about a matter of fact—that she entered her apartment and there was an intruder inside—and (2) her mistaken belief negated the culpability for Murder because although she intentionally and knowingly caused Jean’s death, she had the right to act in deadly force in self-defense since her belief that deadly force was immediately necessary was reasonable under the circumstances.”
Back in 2018, Guyger fatally shot Jean as he was in his apartment eating ice cream. The former cop lived directly a floor under the victim and claimed that she mistook him for an intruder when she entered his apartment instead of her own.
During the call 911, Guyger told the operator numerous times that she thought it was her apartment. In October 2019, a jury found the ex-cop guilty of murder.
Last year, Allisa Findley, Jean’s sister, called Guyger’s appeal of the murder conviction “disrespectful.”
“Jean was doing nothing wrong on the day he was murdered,” Findley said. “Jean was sitting in his own apartment, minding his own business. I feel like she received a slap on the wrist for taking my brother’s life. This tells me that she feels like she didn’t do anything wrong. She did not step on my brother’s toe. She took his life.”
